By an agreement dated 17 october 19997 as amended by an agreement dated 4 march 1999 both of which are made between francis john fry ("the owner") and the company ("the building agreement") it was agreed that the company might enter upon certain land situate at marsh farm,chilton trinity,bridgwater,somerset ("the development land") for the purpose of carrying out certain development thereon ("the development") more fully described in the building agreement and that the owner would sell the development land in parcels as it was developed and share the proceeds of sale between them.
