Brief description
(1) by way of legal mortgage, the freehold property to known as smithfield square birmingham and currently described at hm land registry as land at moseley street and on the south side of cheapside birmingham, and registered at land registry under title numbers MM91320 and WM187510 and any other freehold, leasehold or commonhold property owned by the chargor or which may in the future be owned by the chargor; (2) by way of fixed charge: (a) all present and future estates or interests of the chargor in, or over, any freehold, leasehold or commonhold property (other than any such property effectively mortgaged under clause 3.1 of the instrument); (b) all the intellectual property; (c) all licences, consents and authorisations (statutory or otherwise) held or required in connection with its business or the use of any secured asset, and all rights in connection with them; and (d) the benefit of all contracts, guarantees, appointments and warranties relating to each charged property and / or the units and other documents to which the chargor is a party or which are in its favour or of which it has the benefit relating to any letting, development, sale, purchase, use or the operation of any charged property and / or the units or otherwise relating to any charged property and / or the units . for further details please see the instrument.
