The sums guaranteed by the company pursuant to an unconditional guaranty of payment and performance dated 1 june 1999 (the "guarantee) including all sums and other obligations of bomanton international limited to the chargee, pursuant to any relevant agreement (as defined in the mezzanine facilities agreement dated 1 june 1999 bewteen bomanton international limited and the chargee (the "mezzanine facilities agreement)) including, but not limited to, the obligations set forth in the mezzanine facilities agreement, howsoever created, arising, or evidenced, whether direct or indirect, absolute or contingent, or now or hereafter existing, or due or to become due, including, but not limited to, all obligations that are created by, relate to, arise out of, or are evidenced by a relevant agreement, together with costs and expenses incurred by the chargee in enforcing the guarnatee (the "obligations")
