Short particulars
By section 2.02(a) of the dee, in the event of the company receiving or recovering any payment or distribution in respect of the subordinated debt (including by way of set-off) at any time (other than by means of a permitted payment) the company shall pay such sum to the chargees, immediately upon receiving or recovering the same and pending such payment shall hold the same in trust for the chargees..
