Amount secured
The company's obligations under the building contract and the obligations of the company to pay all and any costs losses fees expenses damages and other amounts arising directly or indirectly as a result of any breach termination or frustration thereof which shall (for the avoidance of doubt) include all costs fees expenses and amounts incurred in connection with the completion of the works regardless of how the building contract came to an end ("the secured obligations").
Short particulars
Fixed and floating charge the company as beneficial owner and with full title guarantee:- charges all its rights to and interest in the account and in the monies deposited therein to the chargee by way of first fixed charge as a continuing security for the performance of the secured obligations in accordance with clause 2 of the charge and by way of floating charge its present and future undertaking assets and rights whatever and whenever.
