Short particulars
The company under the subordination agreement has undertaken to the society trustee that if any obligor makes any payment in cash or in kind of all or any part of the junior liabilities or any junior creditor receives all or any amount in cash or in kind of the junior liabilities in each case, the junior creditor concerned shall hold the same upon trust for application in or towards payment of all senior liabilities, promptly pay an amount equal to that discharged or purported to be discharged for application in or towards payment of all the senior liabilities.
