Short particulars
If at any time prior to the earlier of the two dates specified in the form 395 (a) the company receives a payment or distribution in cash or in kind, or on any account of, any subordinated liabilities. (B) the company receives the proceeds of any enforcement of any security conferred by the security documents. (C) either munroe k limited or david aspin makes any payment or distribution in cash or in kind on account of the purchase or other aquisition of any of the subordinated liabilities the company will forthwith pay any and all such amounts to the security trustee..
