Brief description
All and whole the subjects known as ten dunarn street, newtyle, PH12 8UH being the subjects more particularly described in and disponed by disposition by the angus district council in favour of james clark honey and mrs margaret ethel honey registered in the general register of sasines for the county of angus on fourth december nineteen hundred and eighty five, under exception of (a) that plot or area of ground containing one hundred and three square metres and thirty five hundredths of a square metre being the subjects more particularly described in, disponed by and shown coloured pink on the plan annexed and signed as relative to the disposition by the said james clark honey and mrs margaret ethel honey in favour of the said angus district council recorded in the said division of the general register of sasines on twenty eighth august nineteen hundred and eighty seven; and (b) the area of ground shown shaded green and hatched black on the plan annexed and executed as relative hereto (“the said plan”) and forming part of the subjects registered in the land register of scotland under title number ANG10791, which subjects hereby secured are shown shaded pink on the said plan; together with by way of inclusion and not exception, (one) the dwellinghouse known ten dunarn street, newtyle, PH12 8UH, and all other buildings and erections on the subjects hereby disponed, (two) a right of common property in and to the mutual access pathway coloured blue on the said plan, and also to the access pathways shown coloured green on the said plan (three) the whole rights, sole, joint, common, mutual or otherwise pertaining to the said subjects including all rights of access as described in the said disposition in favour of the said james clark honey and mrs margaret ethel honey recorded as aforesaid, (four) the whole parts, privileges and pertinents pertaining thereto, (five) the whole fittings and fixtures therein and thereon and (six) the borrowers whole right, title and interest in and to the subjects hereby secured.
