Brief description
The company has sub-charged (by way of security for the discharge of the secured liabilities (as defined in the loan agreement dated 5TH august 1997 made between the borrower, the issuer and the trustee (the principal loan agreement) and a first supplemental loan agreement dated 26TH november 1998 made between the parties hereto and any other supplemental loan agreement entered into between the parties (the supplemental loan agreement) (together the loan agreement)), securing a fixed rate sterling loan in the aggregate principal amount (subject to the terms and conditions of the loan agreement) of £33,000,000 and the further supplemental issue of £18,000,000 8 1/8 per cent. Secured bonds due 2037 (the bonds) to be consolidated to form a single series with the existing £212,600,000 8 1/8 per cent. Secured bonds due 2037 with full title guarantee and subject to the proviso for redemption a mortgage dated 26TH august 2020 made between bromford housing association limited (1) and the company (2) (“the mortgage”) and (a) charged at law the payment of the monies secured by this deed dated 26TH august 2020 by way of a first priority mortgage the indebtedness secured by the mortgage in favour of the prudential trustee company limited as trustee and (b) charged by way of first fixed legal mortgage to prudential trustee company limited as trustee all its rights, title, interest and benefit , present and future in and to each of the incoming properties (as defined in the mortgage) title to which is registered at the land registry.
